The Government has decided not to make any changes to the rules applying to residential property and investment-regulated pension schemes. This follows news brought by The Budget 2013 that the Government was to explore changes to pension investment rules, by encouraging the conversion of unused space in commercial properties to residential. This could have triggered the introduction of residential property in SSASs, SIPPs, and Family SIPPs.

The Finance Act 2013 which received Royal Assent on 17 July 2013, included legislation to reduce the lifetime allowance from £1.5m to £1.25m from 2014/15, as well as for fixed protection (FP2014), intended to protect savers who may be affected by the reduction in the lifetime allowance.

The FSA’s paper CP12/5, published in March 2012, proposed that “for all personal pension schemes, disclosure documents should include projections, effect of charges and reduction in yield information… …unless equivalent disclosure rules apply to all schemes, no matter how invested, consumers and advisers will not have the information they need to understand the costs and benefits applying to competing schemes and to identify an appropriate and cost-effective personal pension choice.”

Following the Chancellor’s Autumn Statement of 5 December 2012 and confirmation in the Budget on 20 March 2013, HM Revenue & Customs (HMRC) will now introduce legislation to increase the upper limit on capped drawdown from 100% to 120% of the ‘basis amount’, for drawdown pension years which began on or after 26 March 2013.

New Government legislation for automatic enrolment into a workplace pension compels all UK employers to enrol eligible jobholders into a qualifying workplace pension scheme, which will have to meet new quality standards, including minimum employee and employer contributions. What may not be immediately apparent is that if an employee is enrolled into their employer’s scheme, any pension protection they may currently have under existing schemes, will be lost.

From 1 January 2013, the industry begins to operate under a new advisory regime for regulated retail investment products such as the Rowanmoor Pensions Self-Invested Personal Pension (SIPP) and Family Pension Trust (Family SIPP). The Rowanmoor Pensions SSAS is not defined as a retail investment product and not subject to RDR requirements.

In December 2011, HM Treasury issued a consultation paper on the adoption of gender neutrality on personal insurances, which in turn led to a European Court Ruling earlier this year forcing the UK to proceed. From 6 April 2012 the concept of protected rights for money purchase schemes will be abolished meaning any current protected rights funds will become ordinary scheme benefits; with all the additional benefits of flexibility and control that come with that.

On 25 November Her Majesty’s Revenue and Customs (HMRC) published a change to its interpretation of how carry-forward is calculated. The change in calculation method is a positive change as it potentially increases the tax relievable contribution that can be paid using the carry-forward facility.

The lifetime allowance is reducing from £1.8 million to £1.5 million with effect from 6 April 2012. With the lifetime allowance being reduced, there is an opportunity to apply for lifetime allowance protection called fixed protection. Fixed protection preserves the lifetime allowance at the current level of £1.8 million.
